Refunds

A learner may express their right to cancel their purchase via email up to 30 days prior to course commencement. On this expression a full refund will be issued without undue delay and in any event not later than 14 days.

If a refund is requested in writing less than 30 days prior to commencement a Service and Administrative charge of €100 will be deducted from the refund due. Refunds are issued to the card from which the programme fees were taken. In the cases of deferral a student’s initial purchase will be considered their commencement and as such a €100 charge may be deducted from their fees upon cancellation of their new intake.

Once the course has been commenced by a student, this is an indication of use of service and express acceptance of the above terms and conditions, and as a result no refunds will be issued at that point as it negates the cooling off period.

MCDT reserves the right to cancel, postpone or modify the course delivery dates. This will only occur to such an extent as is necessary.

Audio & Video Recording

All MCDT online lectures are recorded. You are not obliged to appear on camera, however if you do have your camera and your microphone on you may feature in the recording. Recordings are shared with the participants of that class via private and unlisted links. Any unauthorised sharing of the recordings is prohibited.

Online Chat Groups

MCDT will request your permission to add you to a students whatsapp group. MCDT will not be responsible or liable for information shared between students on the group. MCDT reserves the right to suspend the group in the event that information shared within causes offence or harm to those participating.

Covid-19 Measures

MCDT pledges to put in place a series of safeguards inline with public health advice to ensure the college is a safe learning environment. It is also an obligation of the students that attend the college that they in turn follow the current public health advice at the time of attendance which may include mask wearing, social distancing and other measures. MCDT refers the right to temporarily suspend in person classes in line with public health advice or revert to online learning to implement in order to follow such advice.

Intellectual Property Rights

The intellectual property rights in or arising out of or in connection with the Training, including any associated Training Materials shall be owned by MCDT. No reproductions, scans or copies (wholly or in part) shall be made of the Training Material without the prior written consent of MCDT

Payments Terms For Learners

Learners will be granted access to the course once course fees have been paid in full.
Failure to make payments for subsequent terms before commencement will result in students being withdrawn from the course. All fees paid up to this point are non-refundable and non-transferable.

Leave of Absence

A Leave of absence may be accommodated for learners in extenuating circumstances and this is at the discretion of MCDT

Course Holidays

MCDT reserves the right to change a class date inline with public holidays e.g. if a course takes place each Monday and a particular class falls on a Monday that is a public holiday, MCDT refers the right to defer that class to a later date.

Force Majeure

MCDT will not be liable or responsible for any failure to perform or delay in performance of any of its obligations under the Conditions that is caused by events outside reasonable control (a “Force Majeure Event”).

A Force Majeure Event includes any acts, events, non occurrence, omission or accident beyond reasonable control and includes, in particular (without limitation) the following:

  • fire, explosion, storm, flood, earthquake, subsidence, epidemic, other natural disaster; or
  • impossibility of the use of railways and buses
  • impossibility of the use of public or private telecommunication networks

MCDT will take reasonable steps (if within its reasonable control) to bring the Force Majeure Event to a close or to find a solution by which it can perform its obligations under the Agreement despite the Force Majeure Event.

Privacy and Security

We are committed to protecting your privacy and security. All personal data that we collect from you will be processed in accordance with our Privacy Policy. You should review our Privacy Policy. which is incorporated into these Terms by this reference.

Code of Conduct

All staff and students of the Academy are expected to abide by its Code of Conduct. In the case of serious breaches, students may not be permitted to attend the remainder of their course, and no refund will be given.

Limitation of Liability

You expressly understand and agree that (to the fullest extent permitted by law), MCDT shall not be liable for any direct, indirect, incidental, special, consequential, exemplary or punitive damages, or any other damages whatsoever, including but not limited to, damages for loss of profits or contracts, income or revenue, goodwill, anticipated savings, data or other intangible losses (even if we have been advised of the possibility of such damages), arising out of, or resulting from:

  • the use or the inability to use the Site;
  • the use of any content or other material on the Site or any website or websites linked to the Site;
  • unauthorised access to or alteration of your transmissions or data;
  • statements or conduct of any third party on the Site; or
  • any other matter relating to the Site.

If you are dissatisfied with these Terms, your sole and exclusive remedy is the discontinuation of the use of the Site.
